In a heartbreaking accident last week, 9-year-old twin sisters were killed in a head-on collision in Lake Mary. According to the Florida Highway Patrol, an Acura sedan crossed a double yellow line and crashed into an oncoming Toyota Corolla. The twin girls were in the Corolla and died in the wreck. Troopers say the twin girls were not wearing their seatbelt. The accident is currently under investigation and charges are pending against the Acura’s 24-year-old driver.

We rely on a variety of products, including our vehicles, to get us through the day. When a vehicle is faulty or has a faulty part such as a defectively designed airbag, our safety is immediately at risk. Unfortunately, automakers often put dangerous vehicles into the stream of commerce, which lead to serious, even deadly injuries. If you have been injured in an accident involving a defective airbag, you must consult a reliable Miami injury attorney who understand Florida personal injury law and can vigorously assert your rights.

Liability in Airbag Recall Cases

Airbag defects can lead to serious injuries such as broken bones, skull fractures, nerve damage, lacerations, cuts, bruises, brain injury, spine injury and even death. If you or someone you love suffered an injury due to a defective airbag, you may be eligible for compensation through a products liability claim. Typically, a product liability claim for any defective item will fall into one of three categories: a manufacturing defect, a design defect and/or a warning defect. Manufacturing defects take place when there is a defect in a product that was not intended. In other words, the product departs from the intended design. A design defect, on the other hand, occurs when the product is created as intended but the design is inherently dangerous. A warning defect occurs when products do not come with warnings to alert users about risks associated with the product’s use. You should be aware that product liability cases are incredibly complex.

While all truck accidents are dangerous, fuel and tanker trucks pose an added risk. The force of an accident can cause the flammable liquid that the truck is carrying to catch on fire. In some cases, the force of a crash can lead to an explosion. As such, fuel truck accidents can lead to catastrophic, even deadly harm. If you have been hurt or someone you know has been killed in a fuel truck accident, you need skilled legal counsel. Our Miami truck accident lawyers can help you file a lawsuit against any and all parties responsible for the accident.

Two People Killed in Fuel Truck Accident

Last month, two people were killed in their Chevy Impala in a multi-car crash involving a fuel truck along Florida’s turnpike. The accident was caused by the driver of a Honda Civic who fails to navigate a curve on the northbound entrance ramp of the turnpike and slammed into a Tropic Oil Co. truck, which then crashed into the Impala as well as a Ford van. Passengers of the van and the fuel truck sustained injuries. A hazardous materials team was dispatched to the scene to contain the fuel leaking from the truck and part of the highway had to be shut down for several hours.

Truck accidents, due to their sheer size and weight, can lead to devastating harm to everyone involved. If you or someone close to you has been injured in an accident in which a truck was blocking a road, you may be able to recover monetary damages for your harm. Our reputable Miami truck accident attorneys have the skill, dedication and experience to handle your case. We will make every effort to settle your case but we are not afraid to go to trial if a fair settlement cannot be reached through the process of negotiation.

Blocking Accidents

Blocking accidents refer to accidents that involve a smaller vehicles crashing into with large truck that is stopped or parked in the road or in the shoulder. For example, a car rear-ends a truck that is parked in the roadway. Truck drivers who stop their vehicles in the path of moving traffic can lead to catastrophic wrecks when other drivers come upon the unanticipated obstruction in their path. This is why truck drivers and trucking companies should be careful to place reflective markers or use a flagger to notify drivers that a truck is blocking a lane of travel.

Liability in Blocking Accidents

When a car crashes into a truck that is blocking a lane, the car driver tends to think it is his or her fault. However, this is not always the case. In many instances, the blocking accident occurs because the truck driver or trucking company failed to take steps to minimize the risk of accident. Poor weather conditions, lack of signage and low visibility due to nighttime can all increase the likelihood of an accident. Continue Reading ›

The teenage motorcycle rider was pronounced dead at the scene.

Motorcycle Accident Statistics

The United States Department of Transportation’s National Highway Traffic Safety Administration (NHTSA) found that motorcyclists are 35 times more likely to experience a fatal crash on the road than individuals in passenger cars. Sadly, Florida leads the country in the number of fatal motorcycle accidents every year. In fact, motorcyclists accounted for almost one in five (an estimated 19 percent) of all the motor vehicle fatalities in the state.

If you were injured in a boating accident in Florida, you should speak to a seasoned Miami boating accident attorney who can help you file your claim. Earlier this month, country star Alan Jackson’s son-in-law died in a boating accident in Florida. Ben Selecman, 28, was an assistant district attorney for the Davison County District’s Office in Nashville. He was married to the country star’s daughter, Mattie. No further details have been released regarding the accident as of yet. Unfortunately, this is just one of many tragic boat accidents that have occurred in Florida recently. In another accident, a dad’s accidental throttle push caused a Lee County teenager to fall overboard, hit his head against the propeller and sustain fatal injuries. The incident took place in the Kemp Channel in the lower Keys. In yet another incident this past month, a Vero Beach man was seriously injured when he dove off a boat and was injured by the vessel’s propeller.

Sadly, Florida has more boat accidents every year than any other state. Many times, these accidents take place because people underestimate the dangers of boating. If you have been injured in a boating accident, you may be entitled to compensation for your harm. Individuals injured due to the negligence of a boat operator may be entitled to compensation for medical bills, lost wages, pain and suffering, disability and any other losses associated with the accident.

A 6-year-old boy was killed earlier this month in an all-terrain vehicle (ATV) accident.  According to the local Sheriff’s Office, deputies answered a call for help in Lankland. The boy’s family had brought him to the Polk County Fire Rescue Station. He was flown to the Tampa General Hospital where he subsequently died from his injuries.

The little boy was a passenger on a side-by-side ATV being driven by his 8-year-old brother. Another one of their brothers, aged 10, was following closely behind on another ATV. The two vehicles were headed down on a dirt track, which was routinely used for ATV riding and activities. At some point, the right side of the ATV on which the 6-year-old boy was riding hit a dirt mound, which sent the vehicle to the left where it hit another dirt mound before eventually tipping onto its side.  The little boy was thrown off the ATV, which landed on top of him and caused severe head injuries since he was not wearing a helmet at the time.

A new platform from “Agero,” a self described “transportation solutions” company, recently launched a holistic crash detection response system. The platform is called Driver360 and comes in the form of a software development kit, which can detect car crashes within 30 seconds and alert first responders, insurance carriers and tow services. Basically, it taps into an artificial intelligence and smartphone sensors to detect the crash automatically after it has occurred. The company claims that the technology correctly identified 95 percent of crashes in which an airbag deployed and 88 percent of wrecks requiring a tow.

The initial report to the insurance company provides speed, location and other relevant information. It can also record other trip level information for driver scoring and coaching. While this may seem efficient, it can also lead to insurance companies denying claims over information they receive from the platform. Technology can sometimes malfunction so if the information is in some way inaccurate or downright incorrect, the insurance company could use it to deny claims or increase premiums.
